2. Territorial Scope of Application
Layergram operates worldwide. This legal notice and the terms of use apply to all users regardless of the country from which they access the application or the website. The owner reserves the right to restrict access in territories where distribution or use of the application is not permitted by local law.
3. Intellectual and Industrial Property
3.1. Ownership
The software, source code, algorithms, technical architecture, LMF protocol (Layergram Message Format), interface design (UI/UX), logos, icons, texts, graphics, technical documentation and any other original element of Layergram are the exclusive property of Simone Riccetti, except for third-party components expressly indicated in the licenses section.
3.2. Legal framework of protection
Spain:
- Royal Legislative Decree 1/1996 of 12 April, revised text of the Intellectual Property Law (TRLPI).
- Law 17/2001 of 7 December, on Trademarks.
- Law 11/1986 of 20 March, on Patents.
- Law 1/2019 of 20 February, on Trade Secrets.

- Directive 2009/24/EC of the European Parliament and of the Council on the legal protection of computer programs.
- Regulation (EU) 2017/1001 on the European Union trade mark (EUTM).
- Directive (EU) 2016/943 on the protection of trade secrets.
- Regulation (EU) 2016/679 (GDPR) on data protection.
International / Worldwide:
- Berne Convention for the Protection of Literary and Artistic Works (179 signatory countries), under which Layergram copyright is automatically recognized in all adhering countries without the need for additional registration.
- Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), administered by the WTO, applicable in 164 member countries.
- WIPO Copyright Treaty (WCT).
- Paris Convention for the Protection of Industrial Property.
- Madrid System (WIPO) for the international registration and protection of trademarks.
3.3. Reserved rights
The following are expressly prohibited, in any jurisdiction and without the written authorization of the owner:
- The reproduction, distribution, public communication or transformation of the software or any Layergram content.
- Reverse engineering, decompilation, disassembly or extraction of source code not published under an open source license.
- The creation of derivative works based on the architecture, protocol or design of Layergram without express authorization.
- The use of the name 'Layergram', its logo or any confusingly similar sign to identify similar products or services.
- Unauthorized distribution of the application outside official channels (App Store, Google Play, official website).
4. Trade Name and Trademark
The name 'Layergram' and its associated logo are distinctive signs of Simone Riccetti:
- European Union: trademark registration in process before the European Union Intellectual Property Office (EUIPO), classes 9 and 42.
- International: protection in the process of extension through the Madrid System (WIPO).
Regardless of the status of formal registration, unauthorized use of these signs constitutes an act of unfair competition and/or infringement of intellectual property rights prosecutable in the applicable jurisdictions.
5. Open Source License
Part of the Layergram source code is published under the Apache 2.0 license in the official repository:

The scope of that license is strictly limited to the code published there. It does not imply any transfer of rights over:
- The Layergram trade name and logo.
- The user interface design.
- The parts of the software not published in the repository.
- The LMF protocol in those aspects not publicly documented.
- Any undisclosed trade secret or know-how.
Third-party contributions to the repository are subject to the contribution agreement (CLA or DCO) available in the repository itself.
6. Trade Secrets
Certain parts of Layergram's architecture, infrastructure, internal tooling and know-how constitute trade secrets protected under:
- Law 1/2019 on Trade Secrets (Spain).
- Directive (EU) 2016/943.
- The TRIPS Agreement (international level).
Any unauthorized access, appropriation, disclosure or use of such information may give rise to civil and/or criminal action.
7. Disclaimer of Liability
7.1. Use under the user's responsibility
Layergram is a communication tool designed to protect user privacy. The owner is not responsible for the way users use the application or for any consequences arising from such use in any jurisdiction.
7.2. User legal compliance
The user is solely responsible for ensuring that the use of Layergram complies with the laws in force in their country or region. The owner does not guarantee that the use of the application is lawful in all jurisdictions.
7.3. Limitation of liability
To the maximum extent permitted by applicable law, the owner assumes no liability for any direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, the application.
8. Data Protection and Privacy
The processing of personal data is governed by the Privacy Policy available at:
Layergram applies privacy by design and by default in accordance with:
- GDPR (EU Regulation 2016/679) — EU scope.
- LOPDGDD (Organic Law 3/2018) — Spain scope.
- CCPA (California Consumer Privacy Act) — United States (California) scope.
- PIPEDA — Canada scope.
- LGPD (Lei Geral de Proteção de Dados) — Brazil scope.
9. Applicable Law and Jurisdiction
Users in the European Union
This legal notice is governed by Spanish law. For any dispute, the parties submit to the Courts and Tribunals of Santa Cruz de Tenerife, without prejudice to the non-waivable rights that EU law grants to consumers in their country of residence.
Users outside the European Union
For users outside the EU, the applicable law shall be Spanish law and the competent jurisdiction shall be Santa Cruz de Tenerife, unless mandatory regulations in the user's country establish another mandatory jurisdiction.
